USA Civil War 2020

Apologies in advance for this post. I do not want to fear-monger or fan the flames of baseless conspiracy theories. I do not believe the USA is headed towards a Civil War in 2020, regardless of the outcome of the upcoming election. That said, I have had too many conversations with residents in the USA (including Americans, Canadians and other citizens who are living and/or working in the USA) who are planning for potential civil unrest, including armed conflict. They are looking to Canada for safety and they are planning to “escape”, if necessary. civil war

This post was prompted by a conversation I had with a medical doctor living in Florida. He lives in a slice of paradise near Miami. Mango trees. In his own words, however, he believes America is headed towards “civil war”. Yes, those are his words. A licensed physician.

IMMIGRATION INSURANCE

For individuals in the USA, we are providing immigration insurance. Essentially, if you meet the eligibility requirements, we are assisting clients with application to, potentially, relocate to Canada if, as the American doctor noted above, the USA breaks out into civil war.

The idea here is similar to the “pandemic passports” or “citizenship by investment“. I have spoken about these topics and presented at the international EB5 conference in Las Vegas, back when were able to travel and actually fly to conferences. CBI and these options are normally restricted to high net worth individuals and families.

Unlike pandemic passports and CBI solutions, our immigration insurance may be available to many more applicants. You do not need to be wealthy to qualify.

KEEP CALM, CARRY YOUR PASSPORT

During WWII, the British government published the motivational poster with the slogan “Keep Calm and Carry On”. Since then, the phrase has been adapted to many situations. In my view, we need to be prepared for unforeseen circumstances. For better or worse, 2020 has introduced many situations that were previously disregarded as improbable, or even impossible. We have had to adapt to these new realities we did not realize could come to pass.

Civil War 2020

As you may have learned from my TEDs Talk, my parents met at the University of Chicago and I have many relatives in the USA. I do not want violence and I hope that everyone south of the border stays safe and healthy. At the same time, the American physician above is not the only client who has noted a potential “civil war” in the USA. I have heard the same phrase from clients in Minnesota, Arizona, California and other states. From what I am hearing, the anxiety level in the USA is very high. News of the attempted kidnapping of Michigan Governor Gretchen Whitmer has fanned the flames. QAnon. Proud Boys. Social media has been steering viewers away from progressive media. Our goal, of course, is to help clients achieve their Canadian immigration dreams. If we can help some folks gain status in Canada so they may feel secure, we are doing our job.

Stay Safe & Vote

If you are American, please exercise your right to vote. I am very concerned for our clients in the USA. I am concerned for the safety of my family in the USA. We need to make sure that folks stay safe. I have no idea whether 2021 will be any better than 2020; however, in the interest of ending on a positive note, I believe things are going to get better.

Warning Chinese Nationals

Over the past 6 months, we have seen an increase in the numbers of Chinese citizens who have been victims of fraud and abuse. These are individuals who have submitted applications to the Canadian Embassy in Beijing and/or Hong Kong. In particular, there are a number of immigration consultants and shady firms that are taking advantage of Chinese citizens. We have seen many individuals and families pay fees +$10,000.00 and their applications have been mishandled.

Currently, there are numerous ongoing investigations into large Chinese immigration firms, including criminal convictions. These unscrupulous individuals are taking advantage of the ignorance of their clients. They make false promises and, ultimately, we believe that many people are suffering.

As reported by CBC News, more than 1,200 clients have been negatively affected by NEW CAN CONSULTANTS and WELLONG INTERNATIONAL INVESTMENT CO. This has led to an RCMP investigation in what has become the biggest immigration fraud in Canadian history.

According to CBC NEWS:

Wang pleaded guilty to offences under the Immigration and Refugee Protection Act in July 2015 after the Canada Border Services Agency (CBSA) raided his offices in Richmond and Vancouver and found fraudulent Chinese entry and exit passport stamps and dozens of passports.

He was caught holding a client’s passport with cut-and-paste alterations when he was arrested in October 2014, according to the civil action.

Wang was sentenced to almost seven years in prison but was released on parole after serving less than two years of his sentence.

In addition, the report includes details on how others may be affected:

Wang had 14 employees but some of them were part of a complex scheme that pretended clients were employees to meet immigration residency requirements in Canada while they lived in China.

“Mr. Wang did not report any of the income he earned from his fraudulent immigration consulting services to the Canada Revenue Agency.”

Based on our review of the situation and our meetings with Chinese clients in Winnipeg, we strongly urge all individuals to carefully choose their representatives.

MPNP Investors Conference

Thank you for all those who attended or participated in the EB5 Immigration Investors conference in Las Vegas. In particular, I want to thank those who attended my panel on Canada – MPNP Investors’ streams. The conference was a great opportunity for professionals from around the globe to connect on projects and to share ideas. Increasingly, clients are looking global for immigration solutions and our panel on international options was extremely well attended (standing room only!). Initially, they may be focused on New York or Miami and then, when they explore Canadian options, they need experienced counsel to guide through Canadian immigration law.

MPNP Investor

We were able to connect with lawyers, agents and other professionals from India, China, Vietnam, UK, Hong Kong, Cypress, Grenada and many other jurisdictions. Overall, the EB5 conference was a huge success and all the staff at Clarke Immigration Law is excited to work with business leaders and investors.

During our panel on MPNP, we received many good questions on the program. As noted by the Manitoba government, the Business Investor Stream reopened in Q1 of 2018 (Entrepreneur Pathway). The government has continued to focus on strong applications that includes evidence from investors who genuine interest in Canada and a sound track record of solid business acumen.

On a side note, I will add that Las Vegas was a lot of fun. At Clarke Immigration Law, we firmly believe in building relationships. Our personal connections with professionals from around the world help our clients and the benefits of networking go both ways. Alastair Clarke will be presenting at the EB5 Conference in Las Vegas, USA on January 26th 2018. He was invited to the conference based on his expertise with Canadian immigration applications for business and investors. The focus of his presentation will the “renewed” MPNP Business Investor Stream (BIS).

As noted, the MPNP program for business leaders is currently on hold. The province is processing the ~200 applications that were submitted before Nov 2017 and those will be processed according to the previous procedures.

New procedures will come into effect during the first quarter of 2018. Here are some details:

The renewed Business Investor Stream (BIS) will replace the current PNP-B business immigration category. BIS allows Manitoba to recruit and nominate qualified business investors and entrepreneurs from around the world who have the intent and ability to start or purchase businesses in Manitoba within the first 24 months of arrival in Canada on a temporary work permit. Applicants will no longer be required to submit a deposit of $100,000 to the Manitoba government.

We are advising clients to wait until the renewed BIS stream is launched before submitting an Expression of Interest. While some applicants may submit under the current system, those applicants will not receive an Invitation To Apply.

To prepare for this conference, Clarke Immigration Law has been coordinating the information with the Government of Manitoba, Department of Education and Training (Immigration and Economic Opportunities Division) to ensure the information is 100% correct and up to date. We have received statistics directly from the department which we will be sharing at the conference. Our goal is to provide our clients with the best information so they can make informed decisions for their future and the future of their families.
